Lovense Terms & Conditions for the Wishlist Creator
Effective: December 25, 2023
1. The Wishlist function allows anyone (“Payer”) to support their favorite person (“you”, “your”) by purchasing Lovense products (“Product”) for you via the Wishlist function. All payments made through Wishlist function are made to Lovense. These Terms and Conditions (“Terms”) govern how you and Payer use the Wishlist function. Your use of the Wishlist function is subject to, and you agree to comply with, these Terms and other applicable laws and agreements.
2. After creating your Wishlist link(s), a unique Wishlist code (“Code”) will be sent to you by email. You will need the Code to access or retrieve the Wishlist you have created, or to edit your shipping address.
3. You can share your Wishlist link(s) with friends and social media websites such as Facebook, Twitter, Tumblr, Instagram, etc. You will receive an email every time someone purchases you something from your Wishlist.
4. You agree to comply with all laws applicable to your use of the Wishlist function and affirm that you will not use the Wishlist function for any fraudulent, misleading, inaccurate, or dishonest purpose.
5. You understand and acknowledge that the Product will be shipped to you if the Payer makes the payment and if the Payer requests a refund before you accept the Product, the Product will not be delivered to you. The Product delivered to you is covered under a warranty but cannot be returned for a refund.
6. You agree that Lovense can terminate or suspend your use of the Wishlist function at any time in its sole discretion, and may change or stop offering the Wishlist function at any time in its sole discretion. In no event will Lovense be liable for terminating or suspending your use of the Wishlist function, or for the discontinuation of the Wishlist function. In addition, refunds related to payment are at the discretion of Lovense only.
7. If you provide (or allow Lovense to access) any data, content, or other information in connection with your use of the Wishlist function (collectively, “Personal Data”), then you grant Lovense (and its affiliates) a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use such Personal Data. To protect your personal privacy, we will not disclose your address details or other personal data to the Payer and/or any third party.
8. You agree to indemnify and hold Lovense harmless from any claims, suits, losses, liabilities, damages, costs, and expenses resulting from (a) your breach of the Terms and/or (b) any liability we incur as a result of your use of the Wishlist function.
9. You hereby warrant that you are eighteen (18) years of age or older and have every right to contract in your own name in the above regard.
10. By creating your Wishlist, you hereby agree to Lovense Terms and Conditions and Privacy Policy (collectively, “Lovense Terms”). The Wishlist function is part of the “Lovense Services” under Lovense Terms, and your use of the Wishlist function is deemed part of your use of Lovense Services. In the event of any express conflict between these Terms and the Lovense Terms, these Terms will govern solely with respect to your use of the Wishlist function and solely to the extent of the conflict. These Terms do not alter in any way the terms or conditions of any other agreement you may have with Lovense. Lovense reserves the right to monitor or audit your compliance with these Terms and to update these terms from time to time.
